1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the ClubPlaces platform operated by ClubPlaces ("we", "us", "our"). By creating an account or using our service, you agree to be bound by these Terms. If you do not agree, please do not use the platform.

2. Description of Service

ClubPlaces provides a cloud-based platform for community clubs to manage memberships, events, communications, and payments. The platform includes:

  • Member management and self-service portal
  • Event creation, registration, and attendance tracking
  • Payment collection via Stripe Connect
  • Email communications and announcements
  • Reporting and analytics
  • Custom form builders

3. Accounts and Registration

  • You must provide accurate and complete information when registering
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to create an account
  • Club administrator accounts are responsible for all activity within their club
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. Pricing and Fees

  • ClubPlaces costs £10 per month per club
  • New accounts receive a 30-day free trial with full access to all features
  • A 1.5% ClubPlaces platform fee applies to all online payments processed through Stripe, in addition to Stripe's standard processing fees
  • The platform fee is automatically deducted before funds are transferred to the club's Stripe account
  • We reserve the right to change pricing with 30 days' notice

5. Payment Processing

  • Club payments are processed through Stripe Connect
  • Each club connects their own Stripe account and is the merchant of record for transactions with their members
  • ClubPlaces does not hold club funds at any point
  • Stripe's terms of service apply to payment processing
  • Clubs are responsible for setting their own pricing, refund policies, and payment terms with their members
  • ClubPlaces charges a 1.5% platform fee on all online transactions, which is deducted automatically before funds reach the club's Stripe account, in addition to Stripe's standard processing fees

6. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose
  • Upload harmful, offensive, or discriminatory content
  • Attempt to gain unauthorised access to other accounts or systems
  • Send spam or unsolicited bulk communications through the platform
  • Interfere with or disrupt the platform's infrastructure
  • Reverse-engineer, decompile, or attempt to extract the platform's source code
  • Use the platform to process payments for illegal goods or services
  • Resell access to the platform without our written consent

7. Club Data and Content

  • Clubs retain ownership of all data they upload or create on the platform
  • You grant us a limited licence to store, process, and display your data as necessary to provide the service
  • Club administrators are responsible for ensuring they have appropriate consent to store member data
  • We are a data processor acting on behalf of clubs (who are data controllers) under UK GDPR
  • We will not access your club data except as necessary to provide the service, or as required by law

8. Availability and Support

  • We aim for 99.9% uptime but do not guarantee uninterrupted service
  • Scheduled maintenance will be communicated in advance where possible

  • We reserve the right to modify, suspend, or discontinue features with reasonable notice

9. Limitation of Liability

To the maximum extent permitted by law:

  • ClubPlaces is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you have paid us in the 12 months preceding the claim
  • We are not responsible for the actions of club administrators or the accuracy of club-provided content
  • We are not liable for payment disputes between clubs and their members

10. Cancellation and Termination

  • You may close your account at any time from your account settings
  • After account closure, your data will be retained for 30 days, then permanently deleted
  • You may export your data before the retention period ends
  • We may terminate accounts that violate these Terms, with or without notice

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the platform at least 14 days before they take effect. Your continued use of ClubPlaces after changes constitutes acceptance of the updated Terms.
